Terms of Service

1. Acceptance of Terms

By accessing or using the Aumio Distribution platform ("Aumio," "we," "us," or "our"), including aumiodistro.com and all associated services, APIs, and tools, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the platform.

2. Account Registration

To use Aumio, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. By creating an account, you represent that you meet this requirement.

3. Use of the Platform

You agree to use Aumio only for lawful purposes and in accordance with these Terms. You agree not to:

  • Upload content you do not own or have the rights to distribute
  • Upload content that infringes on intellectual property, privacy, or other rights of third parties
  • Upload content generated by AI without proper disclosure, where required by applicable regulations
  • Use the platform to distribute illegal, harmful, or offensive material
  • Attempt to access other users' accounts, data, or administrative functions
  • Reverse engineer, scrape, or disrupt the platform's infrastructure
  • Use the platform in a way that violates any applicable law or regulation

4. Intellectual Property

Your Content: You retain ownership of all music, artwork, metadata, and other content you upload to Aumio. By uploading content, you grant Aumio a non-exclusive, worldwide license to store, process, distribute, and display your content as necessary to provide the services you have requested (e.g., distribution to streaming platforms, marketing campaigns).

Platform IP: The Aumio platform, including its design, code, AI systems, brand elements, and documentation, is owned by Aumio and protected by intellectual property laws. You may not copy, modify, or redistribute platform elements without written permission.

5. Distribution Services

Aumio provides music distribution to digital streaming platforms (DSPs) through our distribution partners. By using our distribution services, you agree to the additional terms in our Distribution Agreement.

Distribution is subject to content review. Aumio reserves the right to decline distribution of content that violates our policies, third-party rights, or applicable law.

6. Marketing and Advertising Services

Aumio offers advertising campaign management through Meta (Facebook/Instagram) and TikTok advertising APIs. By using these services, you acknowledge that ad spend is paid directly to the advertising platform and is non-refundable once campaigns are active. Aumio is not responsible for the performance or results of advertising campaigns. You are responsible for ensuring your ad content complies with the advertising platform's policies.

7. Payments and Royalties

Royalties from streaming platforms are collected and distributed according to the terms in the Distribution Agreement. Aumio may deduct applicable fees, commissions, and taxes before remitting payments. Payment schedules and minimums are as specified in your account settings.

8. Third-Party Services

Aumio integrates with third-party services including Meta (Facebook/Instagram), TikTok, distribution partners, ACRCloud, Last.fm, and others. Your use of these integrations is subject to the respective third-party terms of service. Aumio is not responsible for the availability, accuracy, or actions of third-party services.

9. Limitation of Liability

To the maximum extent permitted by law, Aumio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from your use of the platform. Our total liability shall not exceed the amount you have paid to Aumio in the twelve (12) months preceding the claim.

10. Termination

You may terminate your account at any time by contacting us. Aumio may suspend or terminate your account for violation of these Terms, with notice where practicable. Upon termination, your right to use the platform ceases immediately. Content already distributed to DSPs may remain available per DSP policies and the Distribution Agreement.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of the updated Terms.
